چکیده
فقه ورزش به عنوان شاخهای از شاخههای فقه از جایگاه ویژهای برخوردار است که به تعیین باید و نبایدهای شرعی رفتارهای ورزشکاران، تماشاگران، مدیران و دیگر عوامل انسانی دخیل در عمل ورزش، میپردازد. فقه ورزش که نسبت «فقه» و «ورزش» در آن ترکیب، نسبت مضاف و مضافٌ الیه است، درصدد است که در گفتمان «تربیتبدنی اسلامی» تجویزات و بایدها و نبایدهایی را از منابعِ شریعت اسلامی (کتاب، سنّت و عقل) استخراج، و برای رفتارهای اختیاریِ عواملِ انسانیِ دخیل در فرایندِ ورزش (اعم از ورزشکاران، مربیان، مدیران، سیاستگذاران و...) حکمی از احکامِ شرعی (واجب، حرام، مستحب، مکروه و مباح) را استنباط کند.
کثرت مسائل و قواعد فقهی پرکاربرد در ورزش، ضرورت تخصّصیسازی فقه، جامعیت اسلام و شریعت و لزوم تدوین نظام تربیتبدنی اسلامی، از مهمترین دلایل ضرورت و اهمیت تشکیل فقه ورزش هستند. این موارد به صورت کتابخانهای و با روش استدلالی –نه با روش میدانی و تکنیک آماری- استخراج شدهاند.

چکیده [English]
As a branch of jurisprudence, sports jurisprudence has a special place that determines the Shari'a dos and don'ts of the behaviors of athletes, spectators, managers and other human factors involved in the practice of sports. The jurisprudence of sports, in which the ratio of "jurisprudence" and "exercise" in the combination, is a plus and minus ratio, tries to find prescriptions and dos and don'ts from the sources of Islamic Sharia (book, tradition and reason) in the discourse of "Islamic physical education". Extracting and inferring a ruling from Sharia rulings (obligatory, forbidden, mustahab, makruh and permissible) for the optional behaviors of human factors involved in the sports process (including athletes, coaches, managers, policy makers, etc.).
The multiplicity of jurisprudential issues and rules widely used in sports, the necessity of specialization of jurisprudence, the comprehensiveness of Islam and Sharia, and the necessity of developing an Islamic physical education system are among the most important reasons for the necessity and importance of the formation of sports jurisprudence. These cases have been extracted in a library and with reasoning method - not with field method and statistical technique.
